The Maintenance Agreement
The Maintenance Agreement will be to maintain the equipment detailed on the list to the standard specified by it's manufacturer. Maintenance of equipment shall not include any materials used in carrying out remedial tasks. Charges for materials used will be invoiced separately, however, no labour charges will be levied If the items covered for maintenance are deemed as not repairable due to unavailability of parts or that the material costs involved are deemed uneconomical by both parties, the equipment shall thereafter be considered as not to be part of the maintenance agreement.
The Company reserves the right to vary the agreed charges subject to 30 days prior written notice except where the customer withdraws affected equipment or terminates the agreement by giving written notice.
Exclusion and Limitations
The agreement covers only the equipment detailed on the list of equipment and provided that the equipment is used in accordance with the manufacturers handbook. It has not been subject to neglect, abuse, misuse, accident, fire, transportation or having been repaired or maintained by any other person than a representative of the Company for the duration of the maintenance period.
The company shall not accept responsibilities for any program or recorded data as which may be lost or damaged. Responsibility for correct housekeeping and provisions of backup of data is to be managed by the customer.
Provisions
Where in judgement of the service engineer, a repair may be affected by returning specific equipment to our service centre, the Company will undertake to install a loan until such a time as a repair can be affected. This installation applies to standard items only and is subject to availability.
All reasonable precautions to ensure the health and safety of the Company's employees whilst on customer premises must be undertaken.
Services Available
Service available
The service shall be offered on weather and traffic conditions, on which the company is dependent but outside their direct control and which from time to time do arise and affect response.
Unscheduled remedial maintenance including replacement of parts, where a part has been exchanged under the terms of the agreement, that part shall become the property of MACOB Systems.
Charges for the service period
The agreement entitles the customer to have maintenance based upon the service available detailed above, between the hours of 10.00 and 17.00 Monday to Friday, excluding public / bank holidays. Service requests by the customer outside the period and times specified shall be charged at the then current standard service rates for labour, travel and expenses.
Period of agreement
The period of agreement shall commence from the contract date agreed for a minimum period of one year and continue thereafter until terminated by 30 days prior to written notice by either party.
